Read these Terms and Conditions carefully before you (“you” means the users of the Software) select “I accept”. By using this Software you agree to be legally bound by the Terms and Conditions contained herein and/or any additional terms and conditions set forth in this license. If you do not agree with the terms of this License, select "I do not accept" at the bottom of this page, in which case the installation of the Software will be canceled.

Changes to Terms and Conditions

Intelerad reserves the right to modify these Terms and Conditions from time to time without notice. You agree to be bound by the Terms and Conditions in effect at the time at which you access the Software. Intelerad assumes no obligation to update the Terms and Conditions. The Terms and Conditions can be found under the Service Portal, located at https://serviceportal.intelerad.com/csm. You agree to review the Terms and Conditions periodically in order to be kept abreast of such modifications and your continued access or use of the Software shall be deemed your conclusive acceptance of such modified Terms and Conditions. If you do not agree with any of the modifications, do not use this Software.

1. Grant of Right to Use. Subject to the provisions of these Terms and Conditions, Intelerad Medical Systems Incorporated ("Licensor") grants you, through Intelerad’s client, a limited, personal, revocable, non-exclusive, non-sub-licensable, non-transferable, non-assignable right to use selected or all IntelePACS modules with related documentation (if any) (collectively, the "Software"). This right will terminate on the earliest of the following events:

  1. When your access is removed;

  2. When Intelerad’s client has no right to use IntelePACS (expired or terminated);

  3. When you are advised by Intelerad’s client that such right is terminated;

  4. When the version used has reached its end of life.

2. Use of Software. No physical or virtual use of or access to the Software outside of the country where the report was made is permitted. Except as permitted under these Terms and Conditions, you may not copy the Software or any portion thereof or modify, translate, reverse-engineer, disassemble or decompile the Software or any portion thereof. You agree to use the Software in accordance with applicable laws.

3. Ownership. The Software is a proprietary product of Licensor or its licensor and is protected under copyright law and international treaty provisions. Between the parties, all intellectual property rights in and to the Software are retained by Licensor. Without limiting the foregoing, you acknowledge that, except as permitted under this License, neither the Software nor your rights and obligations under this License may at any time be sublicensed, redistributed, assigned or transferred, in whole or in part, to any third party.

4. Term and Termination. This License is effective upon receipt by you of the Software and shall continue until terminated as defined by the terms outlined in Section 1. No notice shall be required from Licensor to affect such termination. You may also terminate this License at any time by notifying Licensor in writing of termination. Licensor may terminate this License immediately and without prior notice, if you breach any term of this License. You will erase all copies of the Software, and any portions thereof, to Licensor on termination of this License, or destroy the same and if requested certify in writing to Intelerad’s client that you have done so. IntelePACS is a medical device and is subject to medical device safety and effectiveness requirements imposed by national regulations. In addition to a breach of your licensing terms, any use of the Software after termination may put the health and safety of patients at risk as you will not be advised of the availability of any software patch, bug fix, update or upgrade nor will be informed of Field Safety Notices, Medical Device Recalls or Advisory Notices related to the Software.

5. No Warranty. THIS SOFTWARE IS PROVIDED BY LICENSOR "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY,

OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

6. No Liability. Without limiting the foregoing provisions, Licensor shall not, in any event, be liable for: (a) any loss of use of any computer or loss or corruption of data or the costs of system or data recovery; or (b) any third party claims.

7. Limitations. The limitations contained in paragraphs 5 and 6 above apply regardless of the form of action and whether the liability is based on contract, negligence, tort, strict liability or otherwise, even if Licensor has been advised of the possibility of such liability and even if a fundamental breach or breach of a fundamental term has occurred.

8. Indemnity. You shall indemnify and hold Licensor and its employees, contractors, suppliers, agents, officers, directors and representatives harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including legal fees and expenses) arising out of your use of the Software.

9. Governing Law. This License shall be governed by the laws of the Province of Quebec. If for any reason a court of competent jurisdiction finds any provision of this License, or portion thereof, to be unenforceable, that provision of the License shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this License shall continue in full force and effect.

10. Restrictions and Warnings

Mammography

Mammographic images may only be interpreted on monitors that meet technical specifications reviewed and approved by your national regulatory authority.

Contraindications

Lossy compressed images and digitized film screen images must not be reviewed for primary image interpretations.

Referring Physicians Use

Images for authorized referring physicians are intended for review only and are not appropriate for diagnostic purposes.

Patient Portal

Images viewed in the nuage Patient Portal are not DICOM quality. Such images are intended for review only and are not appropriate for diagnostic purposes.

Our Patient Portal is a web application that allows you to use a mobile device or computer to securely view and share your images and report performed at Herston Private Imaging.

Who creates my account?

When you present at Herston Private Imaging, one of our friendly staff will register your details into our system to create your account. You will receive the URL to the Patent Portal and activation code via email.

How do I activate my account?

The email you receive from Herston Private Imaging will detail the steps you need to take to activate your account. In summary;

  1. Go to the Patient Portal URL

  2. Type your activation code

  3. Create a username and password

  4. Log in to the Patient Portal

Changing my password

  1. Go to the Patient Portal URL This defaults on the Login Screen

  2. Click Forgot Password

  3. Follow the prompts

I forget my password

  1. Go to the Patient Portal URL

This defaults on the Login Screen

  1. Click Forgot Password

  2. Follow the prompts

  3. You will receive an email with a temporary password that you can use to log in and reset your password.

I forget my username

You will receive your username and password in the password recovery email.

How can I delete my account?

Please contact Herston Private Imaging to have your account deleted.

How can I access my reports?

Your reports are in My Exam History. Select an exam to see the corresponding report(s) and image(s).

You can copy and paste your report or print it from the web browser. The portal only permits your images to be downloaded. Unfortunately your report cannot be downloaded from the portal.

I already had my exam. Why can’t I see my report?

Your report will be available 7 days after a Herston Private Imaging Radiologist has finalized your exam.

How can I access my images?

  1. Click My Exam History

  2. Select an exam.

  3. You will have access to reports and corresponding images.

  4. Images are presented as thumbnails that you can click to increase the size of the image. You can also pan and zoom images.

Can I download my images?

  1. Go to the Image Viewer

  2. Click the Download button

What actions can I perform on an image?

You can:

  1. Pan and zoom images

  2. Swipe right or left to see the next or previous image within the same exam (where applicable)

  3. Pinch the image on mobile devices

Where can I get the mobile version of the Patient Portal?

There is no app for the Patient Portal, however, the Patient Portal is viewable on a mobile application.

Who has access to the mobile version of the Patient Portal?

Only patients have access to the mobile version of the Patient Portal.

PATIENT SUBMENU
